1. General Policy
Blue Collar Climate, LLC is committed to delivering professional HVAC services in accordance with the agreed scope of work. Because HVAC services involve labor, diagnostics, time, and installed materials, refunds are limited and subject to the conditions outlined below.
Payment is generally due upon completion of services unless otherwise agreed in writing.
2. No Refunds for Completed Services
Once services have been fully performed in accordance with the agreed scope of work, payments are non-refundable.
This includes:

Diagnostic fees
-
Labor charges
-
Installed parts or equipment
-
Completed maintenance or repair services
Customer dissatisfaction alone does not constitute grounds for a refund when services were completed as agreed.
3. Refunds Due to Contractor Breach
Refunds may be issued if:

Blue Collar Climate, LLC materially breaches the written service agreement, and
-
The breach directly prevents proper completion of the contracted work, and
-
The Company is unable to cure (correct) the issue within a reasonable timeframe.
In such cases, any refund issued shall be limited to the portion of payment directly related to the unfulfilled contractual obligation.
4. Inability to Complete Services
If services cannot be completed due to circumstances within the control of Blue Collar Climate, LLC, a prorated refund may be issued for any portion of services not performed.
If services cannot be completed due to circumstances outside of our control (including but not limited to unsafe conditions, customer refusal of required additional work, inaccessible equipment, or utility-related issues), refunds will not be guaranteed and will be evaluated on a case-by-case basis.
5. Deposits (If Applicable)
For projects requiring a deposit:

Deposits may be refundable only if work has not commenced and materials have not been ordered.

If materials have been ordered or work has begun, deposits may be partially refundable minus incurred costs.
6. Warranty Service
If a repair or installation issue arises that falls within an applicable labor or manufacturer warranty period, Blue Collar Climate, LLC will remedy the issue pursuant to the warranty terms.
Warranty service does not entitle the customer to a refund unless a material breach of contract has occurred.
7. Chargebacks & Payment Disputes
Customers agree to contact Blue Collar Climate, LLC directly to resolve concerns before initiating a credit card chargeback or payment dispute.
Improper chargebacks for validly completed services may be subject to collection efforts and recovery of administrative fees where permitted by law.
8. Limitation of Refund Amount
Under no circumstances shall refunds exceed the amount paid by the customer for the specific service at issue.
Blue Collar Climate, LLC shall not be liable for indirect, incidental, or consequential damages.
9. Governing Law
This Refund Policy shall be governed by and interpreted in accordance with the laws of the State of New York.
